Article IV

ATTAINMENT OF OFFICE

Qualifications
    Section 1. A candidate for any position of the Student Executive Board shall have the following qualifications on the day of filing his candidacy:
        1.1 enrolled for the current semester with a total of at least 15 units as certified by the College;
        1.2 no grade of 3.5 in 6 units in the previous semester and a cumulative general weighted average of at least 2.75;
        1.3 not found guilty of violating any College disciplinary or academic rules and principles;
        1.4 for the Office of the President and Vice President, at least enrolled since the previous school year;
        1.5 for the office of the President an incoming senior; and
        1.6 for the Offices of the Internal and External Vice President, at least an incoming junior.

    Section 2. A candidate for any position of the Class or Program Council shall have been enrolled for the current semester with a total of at least 15 units as certified by the College.

 

Manner of Election
    Section 3. All electoral procedures concerning the SEB, Year Councils, Class and Program Councils shall be governed by the rules and regulations set by the COMELEC.
    Section 4. The candidate who garners the most number of votes shall be declared the winner.
    Section 5. Electoral cases, protests, and petitions shall be forwarded to the COMELEC.

 

Student Executive Board
    Section 6. An election shall be deemed valid only if at least 70% of the student population casts its votes.

    Section 7. Elections shall be held no later than the second week of March.

    Section 8. In case of a tie, the COMELEC shall organize a special election for the contested position not later than 2 weeks following the regular elections.

    Section 9. If a position is contested by only 1 candidate, 60% of the votes must be obtained, otherwise special elections shall be organized.

    Section 10. If the position of the President remains vacant, the Council of Representatives shall appoint any qualified individual.

    Section 11. If any other position remains vacant following the elections, the newly elected President shall appoint a qualified student, subject to the approval of the newly elected SEB.

 

Class and Program Councils
    Section 12. Class and Program Council officers shall be elected by the respective members of the class or program.
    Section 13. Class and Program Council elections shall be held no later than the fourth week from the start of the school year.

    Section 14. In case of a tie, the class or program shall hold a special election within two school days following the regular elections.

 

Year Councils
    Section 15. By virtue of their elective positions, the Class and Program Council Presidents shall become members of the respective Year Councils.

    Section 16. The members of each Year Council shall choose a President and a Vice President among themselves.

 

Vacancies and Tenure
    Section 17. The term of the SEB officers shall begin on the last day of the second semester and end on the last day of the second semester of the following year.

    Section 18. The term of the COR, Class, Program and Year Councils shall end upon the election of their successors.

    Section 19. In case the position of the SEB President becomes vacant, the Internal Vice President shall assume the position and a new Internal Vice President shall be elected.

    Section 20. In case the position of the President of the Year Council, Class Council, or Program Council becomes vacant, the Vice President shall assume the position and a new Vice President shall be elected.

    Section 21. In the event of any vacancy in the SEB, special elections shall be held by the COMELEC.

 

Accountability
    Section 22. Elected SEB officers and committee heads shall refrain from serving as officers or project heads in any organization outside the SEB.
    Section 23. Officers of the Student Government shall be removed from office by impeachment, suspension, or any other appropriate sanctions for willful violation of this constitution, gross neglect of their duties or for any grave offense or misconduct reflecting their moral character.
    Section 24. Any motion for impeachment, suspension, or sanction of any officer may be initiated by any student.
    Section 25. No officer shall be removed, impeached, suspended, or sanctioned without the concurrence of at least two-thirds of the COR.
